Union Government Likely to Notify Three New Supreme Court Judges

Senior officials in the law ministry have indicated that the formal notification approving the appointments of three new Supreme Court judges is in its final stages. The new appointees are expected to assume office immediately following the President’s formal consent.

This development is seen as part of ongoing efforts to strengthen the Supreme Court’s bench and expedite proceedings in light of the increasing pendency of cases. The Constitution of India empowers the President, acting on the recommendation of the Collegium, to appoint judges to the nation’s highest court.

Collegium Recommendations Await Formal Nod

The Supreme Court Collegium, headed by Chief Justice D.Y. Chandrachud, recently finalized and forwarded the names of three high court judges for elevation to the apex court. The recommended names, though yet to be officially disclosed, have been carefully selected based on merit, seniority, and regional representation.

A senior legal expert commented, “Timely appointments to the Supreme Court are imperative for upholding the efficiency and credibility of the judicial system. The Collegium process aims to ensure transparency and fairness while maintaining the integrity of the institution.”

According to official data, the court’s pending cases topped 71,000 by May 2024, underscoring the necessity for prompt appointments. Legal observers emphasize that filling these vacancies will directly bolster the judiciary’s ability to address the backlog and adjudicate on key constitutional and public interest litigations.

Judicial appointments to the Supreme Court have often been a subject of public interest and political debate. The Collegium system, a panel comprising the Chief Justice and four senior-most judges of the Supreme Court, holds the authority to recommend names, which the union government typically notifies following due diligence and clearance by the President.

Commenting on the interplay between the government and the Collegium, former Law Commission member Prof. Dr. Faizan Mustafa noted, “The checks and balances built into the Indian appointment process are designed to prevent dominance by any single branch of government, ensuring judicial independence as a cornerstone of democracy.”

The prospective appointments have garnered a positive response across the legal fraternity. Senior advocate Meenakshi Arora stated, “Timely notification of new judges demonstrates the government’s responsiveness to judicial needs, especially at a time when the Supreme Court faces mounting pressure to deliver timely justice.”

However, some critics have called for greater transparency in the Collegium’s functioning and have urged for more detailed public disclosures about criteria and selection.
